Licensing and Legal

Last updated 23 February 2009

The software for WebGauge's usage metering system has been built on top of a 3rd party firmware distribution (hereafter referred to as "base firmware") which has its own licence terms. The WebGauge software components which have been developed by WebGauge Solutions (hereafter referred to as "WebGauge Software Components") is proprietary and is protected by intellectual property legislation in New Zealand and international agreements and treaties. Some supporting tools (hereafter referred to as "other tools") not part of the original "base firmware", or written by WebGauge Solutions are also separately licenced.

The "base firmware" includes the underlying operating system environment, additional router management packages, and any "DD-WRT" branded user interfaces. The "base firmware" is an open-source product released by NewMedia-NET GmbH, licensed under the GPL Version 2 Licence. For more information, please refer to their website: http://dd-wrt.com/. Note: We have not modified any of their source code, but are merely using their operating system as a platform to run our proprietary software packages.

"WebGauge Software Components" includes the software used to record and report data usage, supporting tools not available as part of the "base firmware", and any "WebGauge" branded user interface components. "WebGauge Software Components" are proprietary, closed-source, and protected by copyright. WebGauge Solutions retains all ownership of its intellectual property. By purchasing a WebGauge router, you recieve a perpetual, non-exclusive licence to use this software while you hold a valid WebGauge subscription. If the subscription is terminated by either party, your licence to use this software is suspended, until such time as the subscription is renewed. You may not reverse-engineer, redistribute, modify or share any intellectual property owned by WebGauge Solutions; or attempt to bypass copy and security protection measures unless for "fair use" as determined by relevant court rulings and legislation in New Zealand jurisdiction.

"Other tools" includess two binaries used to support the "WebGauge software Components", and are separately licenced. Haserl is licensed under the GPLv2, and is available here: http://haserl.sourceforge.net.
Mini_httpd is freeware, and is available here: http://www.acme.com/software/mini_httpd/. Its copyright notice is displayed below:

GPL v2

The GPL licence we are required to display covers the "base firmware" and selected "other tools". It does not cover the proprietary components developed and marketed by WebGauge Solutions

Hardware

The WebGauge Router is based on an award-winning router released by a major hardware manufacturer. Some of the manufacturer's original branding, including legal compliance notices have been kept intact. Under no circumstances does WebGauge Solutions aim to misrepresent our value-added product as being produced by the original manufacturer, nor hold the original manufacturer responsible for any issues which may arise as a result of using our custom firmware.
